Abstract

In order to avoid the wreck of democracy provoked by autocratic regimes, it is not enough to separate public functions from different organs. It is necessary to balance the powers assigned to these agencies. And this is only achieved when each of them enjoys sufficient autonomy to fulfill their own purposes and the necessary independence to avoid the usurpation of their functions or the interference of other powers in attributions that are essential for the realization of their own ends. To this end, the Constitution must ensure the balance of power by regulating its distribution.
