Cross-references between the European Court and the Inter- American Court of Human Rights: From influence to dialogue?

Abstract

This work provides the results of empirical research on reciprocal quotations and references between the European Court and the Inter American Court of Human Rights recognized in the grounds of their decisions. The analysis of the jurisprudence of both courts clearly shows the original influence of the European Court on the Inter-American Court, but in recent years has operated an interpretive
convergence, especially in the area of due process and serious violations of human
rights, areas on which the Inter-American Court has advanced experience. The reciprocal quotations and influences between the two courts sponsor a move towards a rich dialogue.
