Abstract

After exposing the genesis of the Ecuadorian constitution of 2008, the author highlights the fact that it strengthens the democratic principle and the judicial function, since it would recognize the people, as holder of the Constituent Power, the function of control regarding the acts of the public powers, and to the Constitutional Court, for its part, the quality of ultimate and definitive guarantee of the effectiveness of the constitutional model as a whole.
