Who Drafts The New Constitution: A Popular Assembly or the National Congress?

Abstract

Given Chilean constitutional history, the article argues against a popular assembly to draft a new constitution. Instead, it favours representative democracy and proposes that constitutional change be channelled through the National Congress.
