I. Previous precisions
The effective protection of constitutional precepts, values and principles will only be fully and satisfactorily achieved when there is a procedural system that protects them. Those who exercise public functions —the governors— as well as the inhabitants of the nation —the governed— have the rights and duties that the Charter assures them and in the cases in which anyone exceeds them, the Constitutional conflict arises, which occurs when a public body or a person, with his action or omission, generates as a result the infraction of precepts or principles contained in the Political Constitution.
