The nullity of public law; jurisprudential trends

Abstract

Much has been written about the nullity of public law in the Chilean constitutional and legal system, in terms of its legal nature and its effects. Notwithstanding this, we consider it pertinent to return to the matter in order to highlight the substantial change observed in the most recent jurisprudential trends, especially regarding the prescription of the patrimonial effects derived from the null act declared invalid by court decision.
