Abstract

This paper aims to analyze and discuss how due process is collected in Law No. 19.880,and if there is to some extent tension between the valuation rules of evidence contained in that law and the right to due process. To discuss this, we will take as example recent cases decided by the Superintendency of Securities and Insurance, henceforth the “SVS”,on punitive matters.
