The Secret of 50 Years of the Archives of the National Commission of Political Prison and Torture (Valech I): Neither Truth nor Justice

Abstract

Subsequent to the presentation of the Report of the National Commission on Political Prison and Torture, Law No. 19.992, through article 15, established the secrecy of the documents, testimony and background provided by the victims before the Commission, which will be maintained for the term of 50 years. In the pages that follow we will examine this secret, and the way in which it constitutes an obstacle to the achievement of truth and justice by the serious violations of human rights that have occurred in Chile. We will end by reflecting on some ways to deal with this rule, in order to allow the investigation, prosecution and punishment of these crimes.
