The Constitution, as a fundamental regulatory text in a country´s life, is ideal for achieving and allowing the absolute freedom and dignity of individuals, groups and social classes under equal conditions. In that regard the current research develops a criticism in the absence of a constitutional right that empowers the citizen to reroute the public expenditure, as well as subjective public rights, like the one established in the principle of effective judicial protection which can help accomplishing such ideals before the non-direct citizen involvement, in the decision-making process at the current historical, political, economic and social reality that we are living in Mexico.
