Abstract
Article 55 of the General Urban Planning and Construction Law prohibits constructions in rural areas, allowing, on an exceptional basis, the construction of the property owner’s house and the one of his employees. The Comptroller General of the Republic has restricted the scope of this law, excluding the application of article 55 to Ecological Preservation Areas of the Santiago Metropolitan Regulatory Plan, which, in this author’s opinion, violates the principle of normative hierarchy.
